1. Acceptance of Terms

By downloading, installing, or using any Mrky product or service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our products. These Terms constitute a legally binding agreement between you and Mrky ("we," "us," or "our").

2. Description of Service

Mrky provides digital software products for language acquisition, including:

• Mrky Desktop — a Windows desktop application for reading digital content with built-in translation, vocabulary flashcard creation, and spaced repetition review.
• Mrky Browser Extension (forthcoming) — a browser extension providing translation, word coloring, OCR, and cloud-synced flashcards across the web, available on a subscription basis.

3. License Grant

Upon purchase, Mrky grants you a personal, non-exclusive, non-transferable, limited license to install and use the software on a single device for your own personal, non-commercial use. You may not:

• Copy, modify, distribute, sell, or sublicense the software
• Reverse engineer, decompile, or disassemble the software
• Transfer your license to another person or device without written permission
• Use the software for any commercial purpose

4. User Content and Responsibility

Mrky is a reading and learning tool. You are solely responsible for any content you load into the application. You represent and warrant that you have the legal right to use any content you access through or load into the software. Mrky does not host, distribute, or facilitate access to any third-party content.

5. Payment and Billing

Payments for Mrky products are processed through authorized payment platforms. Mrky does not directly store or process payment card information. All payment transactions are subject to the terms and conditions of the respective payment platform used at the time of purchase. Subscription billing (for the browser extension) may be cancelled at any time through your account with the payment provider.

6. Intellectual Property

All rights, title, and interest in and to Mrky products, including all associated intellectual property rights, are and will remain the exclusive property of Mrky. These Terms do not grant you any rights to use Mrky's trademarks, logos, or other brand features.

7. Prohibited Uses

You agree not to use Mrky products to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Attempt to gain unauthorized access to any systems or networks
• Distribute malware or engage in any activity that harms Mrky or its users

8. Termination

We reserve the right to terminate or suspend your license at any time, without notice or liability, if you breach these Terms. Upon termination, your right to use the software ceases immediately. For subscription products, you may cancel at any time; cancellation takes effect at the end of the current billing period.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MRKY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the date at the top of this page. Continued use of the software after such changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
